民事调解活动心理分析

案情简介
      公民张某急需一笔资金从事服装批发与零售业务，于是找到熟人李某借款5万元。1999年4月1日，双方签订了借款合同。合同中约定，向李某借款人民币5万元，从4月10日起，借款期限6个月。应李某要求，张某将其一处平房作担保，折价人民币3万元。双方于4月8日办理了抵押登记。李某与4月10日将3万元交给张某。李某称以一处平房担保还不够，提出再提供一项担保。张某于是找到好友王某、毛某，要他们向李某担保。王某、毛某二人立即写了一份担保书：如果张某到期不还款，并无其他财产可供执行，王某、毛某愿意承担还款责任。4月12日，毛某、王某分别在担保书上签字，李某收下担保书。
案例:8月1日，张某因着急用钱，将其已经设定抵押的平房作价2.5万元卖给赵某。此事李某尚不知情，赵某也不知道房屋抵押一事。
      10月1日，李某按约定要求张某还款3万元，并要求其支付利息3000元。张某称无钱还款，李某欲申请人民法院拍卖张某的房屋，却发现房屋已经由赵某居住。李某与是找到王某承担担保责任，王某称张某有一处房产，应先于执行主财产，再强制执行张某其他财产及毛某财产，之后才可要求其承担担保责任。
